1. About ViaHopTrip

ViaHopTrip is a travel marketplace operated by Hopline Transfers Inc., a New York corporation.

ViaHopTrip / Hopline Transfers Inc.

6411 19th Avenue, 2nd Floor

Brooklyn, New York 11204

United States

hello@viahoptrip.com

In these Terms & Conditions (the “Terms”), “ViaHopTrip”, “we”, “us” and “our” mean Hopline Transfers Inc., which operates the ViaHopTrip website, applications and related services (together, the “Services”). “You” means the person using the Services. A “Supplier” is an independent business or individual that offers a travel-related service through ViaHopTrip. A “Booking” is a reservation of a Supplier’s service that the Services have confirmed.

These Terms apply to everyone who uses the Services, including customers who search for, request or book services. Suppliers who list services on ViaHopTrip are also bound by the supplier terms, plan terms and any other agreement presented to them when they register or subscribe. Those terms apply in addition to these Terms.

2. Acceptance of these Terms

By creating an account, making a Booking, submitting a request, accepting an offer or otherwise using the Services, you agree to these Terms and to the documents they refer to, including the Privacy Policy and the booking-specific conditions shown to you before you book. If you do not agree, please do not use the Services.

If you use the Services for a company or for another person, you confirm that you are authorised to accept these Terms for them, and “you” then includes that company or person.

3. Eligibility and accounts

To use the Services, you must:

  • be at least 18 years old and legally capable of entering into a binding agreement;
  • provide accurate, current and complete information about yourself and about every traveller included in a Booking;
  • keep your login credentials confidential and secure, and tell us promptly at hello@viahoptrip.com if you believe your account has been used without your permission;
  • update your information when it changes.

You are responsible for activity carried out through your account, except where it results from our own failure to keep the Services reasonably secure.

We may suspend, restrict or close an account that we reasonably believe is involved in fraud, abuse, a security threat, unlawful activity or a material breach of these Terms. Where it is appropriate and lawful to do so, we will tell you the reason.

4. Our role as a marketplace

ViaHopTrip is an online marketplace. We help you discover travel services, request and compare offers, make Bookings, communicate with Suppliers and, where available, pay for Bookings. Unless a particular Booking expressly states otherwise, Hopline Transfers Inc. acts only as the operator of the marketplace and is not the provider, operator, carrier, host or organiser of the underlying travel service.

The contract for the travel service itself is between you and the Supplier named in your Booking. The Supplier is solely responsible for the service it provides, including:

  • the licences, permits and registrations required to operate;
  • insurance appropriate to the service;
  • the condition, safety and suitability of its vehicles, vessels, properties and equipment;
  • the recruitment, qualification, supervision and conduct of its drivers, captains, guides and other staff;
  • safety procedures and compliance with safety rules;
  • the taxes, duties and charges for which it is responsible;
  • compliance with the laws and regulations that apply to its service;
  • the actual performance of the booked service.

Suppliers are independent. They are not our employees or agents, and we do not direct or control how they perform their services. Listing descriptions, photographs, prices, availability and conditions are provided by Suppliers. We take reasonable steps to keep the marketplace accurate, but we do not guarantee that any Supplier will perform as described.

We may review Supplier applications, documents, ratings or reviews. Any review we carry out is limited to the checks described on the Services at the time. It is not a guarantee of a Supplier’s quality, safety, licensing or insurance and does not replace your own judgement.

Where a Booking expressly states that Hopline Transfers Inc. is the provider of a service, the conditions shown for that Booking will describe our responsibilities for it.

5. How booking works

Depending on the service, a Booking is made in one of these ways:

  • Instant booking: the listing shows a price and availability, and the Booking is confirmed when you complete it.
  • Booking on request: you ask the Supplier to accept, and nothing is confirmed until the Supplier accepts.
  • Requests and offers: you describe what you need (for example, a transfer), Suppliers may send offers or quotes, and a Booking is formed only when you accept one offer.

A request, an offer, an item saved to a trip or a pending booking is not a binding Booking. A Booking becomes binding only when the Services clearly confirm it, on screen and in your account, with a booking reference. Where email delivery is available, we also send a confirmation email. An offer may expire, or be withdrawn by the Supplier, before you accept it.

Please check every confirmation carefully, including names, dates, times, addresses, the number of travellers, the price, the Supplier and the cancellation conditions. Tell the Supplier or us straight away if anything is wrong. We are not responsible for errors in information that you entered.

Availability is controlled by Suppliers and can change quickly. If a Supplier cannot honour a confirmed Booking, section 8 applies.

6. Prices, fees and taxes

Before you complete a Booking, we show you the total price you will be asked to pay and the material terms that affect it. The total includes, where they apply:

  • the price set by the Supplier for the service;
  • any service or booking fee charged by ViaHopTrip, shown as its own line;
  • taxes and mandatory charges known at the time of booking;
  • mandatory Supplier fees that you must pay as a condition of the Booking.

We do not add mandatory charges that were not shown to you before you confirmed. Some charges can arise only from choices you make or circumstances during the service, such as extra waiting time, additional stops, extra guests, damage, local tourist taxes collected on arrival, or extras you request on the day. Where such charges may apply, we tell you before you book, together with how they are calculated where that is known.

Prices are charged in the currency shown on the Booking. If we display a converted amount for convenience, it is an estimate only. Your bank or card issuer may apply its own exchange rate and foreign-transaction fees, which we do not control.

If a price is displayed with an obvious error, such as a price that clearly bears no relation to the service, we may decline or cancel the affected Booking and refund any amount paid, unless applicable law requires otherwise.

7. Payments

Depending on the Booking, you pay either through the Services or directly to the Supplier. Your Booking shows which applies and to whom payment is owed.

Payments made through the Services are processed by third-party payment processors, such as Stripe. Card details are entered into and processed by the payment processor, and ViaHopTrip does not store full payment card numbers. The payment step is also subject to the payment processor’s own terms and privacy notice.

For some Bookings your payment method may be authorised (a temporary hold) when you submit the Booking and charged when it is confirmed; the Booking shows when you will be charged. If a payment fails, is declined or is reversed, the Booking may not be confirmed or may be cancelled, and we or the Supplier may ask you for another payment method.

Refunds due under the applicable cancellation conditions are returned to the original payment method where possible. How long a refund takes to appear depends on your bank or card issuer.

If you think you have been charged incorrectly, please contact us first at hello@viahoptrip.com so we can investigate. This does not limit your right to dispute a charge with your card issuer. If a chargeback is raised for a Booking that was provided as agreed, we may share the relevant booking records with the payment processor and, to the extent permitted by law, recover amounts that were wrongly reversed.

8. Cancellations and refunds

Suppliers set their own cancellation and refund conditions, and those conditions differ between services. The conditions that apply to a Booking are shown before you book and in your confirmation, and they form part of your booking agreement.

Unless the conditions for your Booking say otherwise:

  • Customer cancellation: you may cancel as the conditions for your Booking allow. Whether you receive a refund, and how much, depends on those conditions and on how far in advance you cancel.
  • Supplier cancellation: if the Supplier cancels a confirmed Booking or cannot provide the service booked, you are entitled to a full refund of the amounts you paid for that service through the Services or, if you prefer and one is offered, a suitable alternative.
  • No-show: if you do not arrive, are not at the agreed meeting point, or do not check in within the time allowed by the Booking, the Booking may be treated as a no-show and may not be refunded.
  • Non-refundable Bookings: a Booking marked non-refundable is not refunded if you cancel, except where the Supplier cancels, where the conditions provide otherwise, or where applicable law requires a refund.
  • Partial refunds: some conditions provide a partial refund, depending on timing or on the part of the service already used.
  • ViaHopTrip fees: any ViaHopTrip service fee is refunded when the Supplier cancels or when the Booking is refunded in full because the service could not be provided. In other cases, whether the fee is refundable is shown with the fee.

If events beyond the reasonable control of both you and the Supplier prevent a service from taking place (see section 23), the Booking conditions and applicable law determine whether a refund, credit or rebooking is available. Suppliers remain responsible for refunds due under their conditions.

Nothing in this section limits any cancellation or refund right you have under mandatory consumer protection law.

9. Changes to Bookings

You can ask to change a Booking through your account, by contacting the Supplier or by contacting us. Changes depend on the Supplier’s availability and conditions and are not guaranteed. A change may lead to a price difference, an additional charge or a partial refund, which we show you before the change is confirmed. Your Booking stays as originally confirmed until a change is confirmed.

A Supplier may make a minor operational change, such as providing a vehicle of the same or a higher class, a different driver or guide, or a small adjustment to timing. If a Supplier needs to make a significant change to a confirmed Booking, you may accept the change or cancel and receive a refund of the amounts you paid for the affected service.

10. Transfers and transportation

When you book a transfer or chauffeur service, you are responsible for giving accurate and complete details, including:

  • the pickup address and the destination;
  • the date and time of pickup;
  • the number of passengers, including children and infants;
  • the number and size of luggage items, including any oversized items;
  • flight, train or ferry details where the pickup is at a terminal;
  • any special requirements, such as child seats, accessibility needs or additional stops.

Waiting time. Your Booking shows any free waiting time that is included. For airport pickups with a correct flight number, waiting time is normally counted from the actual landing time. Waiting beyond the included time may be charged at the rate shown, or the driver may leave after reasonable attempts to contact you.

Delayed flights. Where you have given a correct flight number, Suppliers are expected to adjust the pickup to reasonable flight delays. If your flight is significantly delayed, diverted or cancelled, tell the Supplier as soon as you can. The Supplier will try to rearrange the transfer, but this may not be possible and additional charges may apply.

Missed pickups and lateness. If you are late, cannot be found at the agreed meeting point, or cannot be reached using the contact details you gave, and the driver has waited for the included waiting time, the Booking may be treated as a no-show. If the Supplier does not arrive within a reasonable time of the agreed pickup time, contact the Supplier and us promptly; you may be entitled to a refund under section 8.

Child seats and accessibility. Child seats, booster seats and accessible vehicles are provided only where they are requested and confirmed in the Booking. Local law may require child restraints, and it is your responsibility to request the seats your children need. If an accessibility requirement is essential to your journey, include it in your Booking and make sure it is confirmed before you travel.

Conduct and safety. Drivers may refuse to carry passengers who are abusive or violent, who are intoxicated to a degree that endangers safety, who carry prohibited items, or whose group or luggage exceeds the capacity of the vehicle. Seat belts must be worn where the law requires.

11. Tours and experiences

Tours, activities and experiences are run by their Suppliers. The listing and your Booking show the meeting point, the duration, what is included and any participation requirements.

Please be aware that:

  • Weather: an activity may be changed, shortened, rescheduled or cancelled because of weather or conditions the Supplier reasonably considers unsafe.
  • Minimum numbers: some activities need a minimum number of participants. If the minimum is not reached, the Supplier may cancel or reschedule and must offer you an alternative or a refund.
  • Schedule changes: times, routes and itineraries may change for operational or safety reasons.
  • Age, health and participation requirements: every participant must meet the stated age, health, fitness, height, weight, language or skill requirements, and you must tell the Supplier about any condition relevant to safe participation.
  • Supplier instructions and safety: participants must follow the reasonable safety instructions of the Supplier and its guides. A Supplier may refuse participation to anyone who does not meet the stated requirements or who puts themselves or others at risk, and in that case a refund may not be due.

Some activities carry inherent risks. A Supplier may ask participants to accept its own participation terms or waiver, but such terms cannot exclude liability that the law does not allow to be excluded.

12. Hotels, villas and accommodation

For hotels, villas, apartments and other accommodation:

  • Check-in and check-out: the times shown in your Booking apply. Early arrival or late departure depends on availability and may be charged.
  • Occupancy: the property may be used only by the number and type of guests stated in the Booking. Additional guests may be refused or charged.
  • Deposits: some properties require a security or damage deposit, taken or held as described in the Booking and returned in line with the property’s conditions.
  • House and property rules: guests must follow the property’s rules, for example on noise, smoking, pets, parties and use of facilities.
  • Identification: the property may ask for identification and a payment card at check-in, as required by local law or its own policy.

Descriptions of properties, facilities and amenities are provided by the Supplier. The Supplier’s specific conditions shown before booking apply in addition to these Terms.

13. Boats and yachts

Boat and yacht services are operated by their Suppliers and crews. A maritime service may be changed, delayed, shortened, rerouted or cancelled because of weather, sea conditions, port or marina restrictions, safety requirements or the captain’s reasonable operational decision. The captain has final authority over the safety of the vessel and everyone on board, including whether a trip goes ahead and which route and stops are used.

Guests must follow the crew’s instructions, respect the vessel’s capacity and rules, and disclose any condition relevant to their safety on board. If a trip cannot go ahead for safety reasons, the Booking conditions determine whether a new date, credit or refund is offered, subject to section 8 and applicable law.

14. Travel documents and requirements

You are responsible for making sure that every traveller in your Booking has, and complies with:

  • valid passports and identity documents;
  • visas and transit permits;
  • immigration and entry requirements;
  • health requirements, including vaccinations and health documents;
  • any driving licence, certificate, qualification or other document needed to take part in an activity or use equipment.

We and the Supplier are not responsible if a traveller is refused boarding, entry or participation because the required documents are missing or invalid. Requirements change, so please check them with the relevant authorities before you travel.

15. Reviews

Reviews help travellers choose. Only customers who used a service booked through ViaHopTrip may review that service, and a review must describe the reviewer’s genuine experience.

Suppliers must not review their own services or those of competitors, and must not offer incentives for positive reviews or pressure a customer to change or remove a review.

We may decline, remove or stop displaying content that is:

  • fraudulent or fake, or written by someone who did not use the service;
  • misleading;
  • abusive, harassing or discriminatory;
  • defamatory;
  • illegal or in breach of someone else’s rights;
  • unrelated to an actual service booked through the Services.

We do not remove a review simply because it is negative. By submitting a review, you grant Hopline Transfers Inc. a non-exclusive, worldwide, royalty-free licence to display, reproduce and distribute it in connection with the Services.

16. Prohibited conduct

You must not:

  • make fraudulent, false or speculative bookings or requests;
  • use a payment method without authorisation, or commit payment fraud;
  • abuse chargebacks or refund processes;
  • scrape, crawl or harvest data from the Services by automated means without our written permission;
  • attack, overload, probe or disrupt the Services, including with bots, malware or denial-of-service attacks;
  • access, or attempt to access, accounts, systems or data without authorisation;
  • impersonate any person or business, or misrepresent your connection with one;
  • harass, threaten, abuse or discriminate against Suppliers, drivers, staff, other customers or our team;
  • misuse customer or Supplier information obtained through the Services, including using it for purposes unrelated to a Booking;
  • use the Services for any unlawful purpose.

We may investigate suspected breaches, keep relevant records and cooperate with law enforcement authorities where required or appropriate.

17. Intellectual property

The Services, including the ViaHopTrip software, design, text, graphics, branding, trademarks, databases and original content, belong to Hopline Transfers Inc. or its licensors and are protected by intellectual property laws. Content provided by Suppliers, such as listing descriptions and photographs, belongs to the Supplier or its licensors.

We give you a limited, non-exclusive, non-transferable and revocable permission to use the Services to plan and book travel for yourself, the people you travel with or your organisation, in line with these Terms. You may not copy, modify, distribute, sell or create derivative works from the Services, or use our trademarks, without our prior written permission.

18. Third-party services

The Services use external providers, including for payments, hosting and data storage, authentication, maps, email and other communications, analytics and security, and in some cases booking and availability systems. These providers operate under their own terms and privacy policies.

Links to websites or services that we do not operate are provided for convenience. We are not responsible for the content, availability or practices of third-party websites or services.

19. Availability of the Services

We work to keep the Services available and secure, but we do not guarantee that they will be uninterrupted, error-free or always available. We may carry out maintenance, updates and security measures, and may change, suspend or discontinue features where reasonably necessary. If a change materially affects a confirmed Booking, we will tell you.

20. Disclaimer

To the extent permitted by applicable law, the Services are provided “as is” and “as available”. Except as expressly stated in these Terms, Hopline Transfers Inc. makes no warranties or representations of any kind about the Services, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Because Suppliers are independent, Hopline Transfers Inc. does not warrant or guarantee the quality, safety, legality, suitability or performance of any Supplier or service, or the accuracy of information provided by Suppliers, except where a Booking expressly states that Hopline Transfers Inc. is the provider.

Some jurisdictions do not allow certain warranties to be excluded. In those jurisdictions, these exclusions apply only to the extent the law allows, and nothing in this section affects rights you have that cannot be waived.

21. Limitation of liability

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for gross negligence or willful misconduct, or under consumer protection rights that cannot lawfully be waived.

Subject to the paragraph above and to the fullest extent permitted by applicable law:

  • Hopline Transfers Inc. is not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any Supplier, or for personal injury, death, property damage or other loss arising from a Supplier’s service, because the Supplier and not Hopline Transfers Inc. provides that service;
  • Hopline Transfers Inc. is not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, business, goodwill or data, arising out of or relating to the Services or these Terms;
  • Hopline Transfers Inc.’s total aggregate liability arising out of or relating to the Services or these Terms is limited to the greater of (a) the service fees you paid to Hopline Transfers Inc. (not amounts paid for the Supplier’s service) in connection with the Booking giving rise to the claim, and (b) US$100.

These limitations do not reduce any refund owed to you under section 8 for amounts you paid through the Services. They apply to claims in contract, tort (including negligence), under statute or otherwise, but only to the extent permitted by the law that applies to you.

22. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Hopline Transfers Inc. and its officers, directors, employees and agents from third-party claims, and from the related losses, liabilities and reasonable legal costs, arising from (a) your unlawful use or misuse of the Services, (b) your material breach of these Terms, or (c) your violation of the rights of a third party. This indemnity does not apply to the extent a claim results from our own breach, negligence or misconduct. If you are a consumer, this section applies only as far as the law where you live allows.

23. Force majeure

Neither Hopline Transfers Inc. nor, where applicable, a Supplier is liable for a failure or delay in performance caused by circumstances beyond its reasonable control that could not have been avoided by reasonable precautions, including:

  • severe weather and natural disasters;
  • epidemics and public health emergencies;
  • war, terrorism, civil unrest or riots;
  • strikes or industrial action, other than by the affected party’s own staff;
  • government restrictions, orders or travel advisories;
  • closure of airports, ports, roads or borders;
  • widespread transportation disruption;
  • major failures of utilities, telecommunications or internet infrastructure, and major system outages not caused by a lack of reasonable precautions.

Where such circumstances prevent a service from being provided, section 8 and applicable law determine the refund, credit or alternative available. This section does not remove any refund right you have under mandatory law.

24. Account suspension and termination

You may stop using the Services at any time and may ask us to close your account by contacting hello@viahoptrip.com. Closing your account does not cancel confirmed Bookings, which remain subject to their conditions.

We may suspend or terminate your access to the Services, or cancel pending requests, if you materially breach these Terms, if we reasonably suspect fraud, abuse or unlawful activity, if the law requires it, or where necessary to protect the Services, Suppliers or other users. Where reasonable and lawful, we will give notice and a chance to respond. If we cancel a confirmed Booking for reasons that are not your breach of these Terms, you will receive a refund of the amounts paid through the Services for that Booking.

Provisions that by their nature should continue after termination, including those on amounts owed, intellectual property, disclaimers, limitation of liability, indemnification, governing law and jurisdiction, continue to apply.

25. Changes to these Terms

We may update these Terms, for example to reflect changes to the Services, to the law or to our business. We will post the updated Terms on this page with a new “Last updated” date. For material changes, we will also give reasonable notice where required, for example by email or through a notice in the Services, before the changes take effect.

Updated Terms apply to use of the Services and to Bookings made after they take effect. A Booking you have already confirmed remains subject to the Terms and conditions that applied when you made it, unless the law requires otherwise.

26. Governing law

These Terms and any dispute, claim or controversy arising out of or relating to these Terms, ViaHopTrip or the Services shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict-of-laws principles, except to the extent that mandatory applicable law provides otherwise.

If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of the place where you live that cannot be excluded by agreement.

The contract between you and a Supplier for the travel service itself may be subject to the law stated in that Supplier’s conditions or, where none is stated, to the law that applies under the relevant legal rules.

27. Jurisdiction and venue

Subject to any mandatory rights that cannot lawfully be waived, you and Hopline Transfers Inc. agree to submit to the exclusive jurisdiction of the state courts of the State of New York located in Kings County (Brooklyn), New York, and of the United States District Court for the Eastern District of New York, for any dispute arising from or relating to these Terms or the Services, and each party waives any objection to venue in those courts.

If you are a consumer, mandatory law may give you the right to bring proceedings in the courts where you live, and nothing in this section removes that right. Either party may also bring an individual claim in a small claims court that has jurisdiction.

Before starting proceedings, please contact us at hello@viahoptrip.com. Most concerns can be resolved quickly and informally.

28. Severability

If any provision of these Terms is found to be invalid, illegal or unenforceable, that provision will be enforced to the maximum extent permitted, or limited to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

29. Entire agreement

These Terms, together with the Privacy Policy, the booking-specific conditions shown before you book (including Supplier and cancellation conditions) and any additional terms you accept for a particular feature, form the entire agreement between you and Hopline Transfers Inc. about the Services and replace any earlier understanding on that subject. If they conflict, the booking-specific conditions prevail for that Booking, and otherwise these Terms prevail, except where mandatory law requires a different order.

Our failure to enforce a provision is not a waiver of our right to do so later. You may not transfer your rights or obligations under these Terms without our consent. Hopline Transfers Inc. may transfer its rights and obligations in connection with a merger, acquisition, reorganisation or sale of assets, provided your rights under these Terms are not reduced.

These Terms are written in English. If we provide a translation, the English version prevails to the extent permitted by law.
